The essential components of the delegation decision-making process are made clear by the Five (5) Rights of Delegation. From nursing service administrators to staff nurses, the Five Rights define nurses’ professional and legal responsibilities. To safeguard the public and preserve the integrity of the nursing care delivery system, staff nurses and administrators of nursing services need to collaborate and work together.

In order to determine the educational and training requirements as well as competency assessments for nurses and UAPs, establish organizational standards that are in accordance with the applicable laws and regulations. Instruct and/or assess, verify and identify the UAP’s competency on an individual, task and patient -specific basis. A registered nurse [licensed practical nurse] may delegate nursing activities to other…health care personnel, provided that the delegating registered [licensed practical] nurse shall bear full …responsibility for:

(1) Making an appropriate assignment;

(2) Properly and adequately teaching, directing and supervising the delegatee; and

(3) The outcomes of that delegation [all within the parameters of his/her generic and continuing education and experience.]

Include competence standards in the policies of the institution; evaluate the performance of nurses and UAPs; conduct standards-based evaluations; and take measures to correct violations of standards, such as notifying the Board of Nursing of nurses who violate standards.
  • Based on the needs that have been determined and professional standards, carry out one’s own professional activities, and take steps to correct any shortcomings;
  • Perform evaluations of UAP performance based upon standards and take steps to remedy failure to meet standards.

Keep an eye on the process and evaluate the results. Improve the process and the outcome by sharing data with all parties involved. Situation specific communication includes:

  • Specific data to be collected and method and time for reporting
  • Specific activities to be performed and any patient-specific instruction and limitation; and
  • The expected results or potential complications and time lines for communicating such information

Right Supervision/Evaluation

The delegating licensed nurse or any other licensed nurses chosen by the nursing service administrators or the delegating nurse must provide supervision. The expected method of supervision—direct or indirect—the UAP’s competencies and qualifications, the nature of the delegated tasks, and the patient’s stability or predictability must all be known by the supervising nurse.

Make sure there is a good mix of staff and skills, that there are clear lines of authority and reporting, and that there is enough equipment and supplies to meet all of the needs for nursing care.
